Unfair Dismissal
What is unfair dismissal?
Unfair dismissal means an employee has been fired from their job without adequate or just cause to do so or in a manner that is inherently unfair.
Whatever the circumstances, the reality of an unfair dismissal claim is that it’s grounded in the dismissal of an employee by their employer, without a fair or justified reason for doing so or in the way that they have handled the process.
Who can bring a Claim for unfair dismissal ?
An individual with employee working status, who had a minimum of 2 years of service with the employer.

What might you be entitled to as compensation for unfair dismissal?
When an employee successfully claims unfair dismissal, they might be eligible of a financial compensation. Such compensation award in unfair dismissal cases varies depending on the specific circumstances.
- Basic Award
The basic award is a statutory element of compensation for unfair dismissal. The calculation is based on your age, length of service, and weekly pay, subject to a statutory maximum. The current maximum is £16,320 (as of April 2023).
- Compensatory Award
The compensatory award is designed to compensate the employee for the actual financial loss they have suffered due to the unfair dismissal. This may include lost earnings (both past and future), loss of benefits, and potential loss of pension contributions. However, it is subject to a statutory cap, which is currently £89,493 (or 52 weeks’ gross pay, whichever is lower, as of April 2023).
