Apply for a Administrative Review
If you receive a decision on your visa application in which you believe contains a mistake, you may be eligible to request for an administrative review.
Not all decisions are eligible for an administrative review. You can apply for administrative review if the decision letter from the Home Office states that you can request for the decision to be reviewed. If you are not eligible for administrative review, you may instead be entitled to peruse an Immigration appeal.
- There are three circumstances under which you can submit an administrative review application:
- If you’re outside the UK
- If you’re in the UK
- If your visa was cancelled at the border
- Your request for an administrative review will be withdrawn/cancelled if you:
- Submit any other immigration or visa application
- Request for your passport
- Back for travel purposes
- Leave the UK
You also cannot request a second review unless the first review identifies new reasons which justify the original refusal. Your decision letter will inform you whether you can apply for a second review.
If you do not get a decision on your application within 6 months, the Home Office will contact you with an update regarding your case.
If you’re outside the UK
Under this conditions, you can apply for an administrative review if all of the following apply:
- You are outside the UK
- You applied outside the UK
- Your application was refused
You must apply within 28 days of getting the decision
It can take 12 months or more to get a decision regarding your administrative review in this case.
If you’re in the UK
Under this condition, you can apply for an administrative review if all of the following apply:
- You are in the UK
- You applied whilst in the UK
- Your application was refused or it was granted but you are not satisfied with the conditions of the permission to stay
- You must apply within 14 days of getting the decision (or 7 days if detained)
It can take up to 6 months or more to get a decision regarding your administrative review.
If your visa was cancelled at the border
You can ask for an administrative review if your visa was cancelled for one or more of the following reasons:
- There has been a change in your circumstances
- You provided false information
- You failed to include the relevant information
If you were given temporary admission to the UK and you want to apply for an administrative review you must apply either:
- Within 14 days of your visa being cancelled
- Within 7 days if you were detained on the date your visa was cancelled (you must do this in the UK)
If your visa was cancelled at border controls outside the UK and you want an administrative review, you must apply within 28 days of your visa being cancelled in any of the following cities:
- Paris
- Brussels
- Dunkirk
- Coquelles
- Calais
- Lille
It can take up to 28 days or more to get a decision regarding your administrative review if you apply under the condition that your visa was cancelled at the border.
