What is the UK Partner Visa?

The Unmarried Partner Visa allows long-term partners of British or Irish citizens, those settled in the UK, individuals with pre-settled status, holders of a Turkish Businessperson or Turkish Worker visa, and those with refugee or humanitarian protection status to join or stay with their unmarried partner in the UK. You can also apply if your partner is outside the UK but intends to return with you. After 5 years, this visa can lead to indefinite leave to remain or settlement in the UK.

Unmarried Partner Visa Eligibility Criteria

To be eligible for a UK Unmarried Partner Visa, you must meet the following requirements set by UK Visas and Immigration:

  • Your partner must be British or Irish, settled in the UK, hold pre-settled status, possess a Turkish Businessperson or Turkish Worker visa, or have refugee status or humanitarian protection.
  • Both you and your partner must be at least 18 years old.
  • You and your partner must have met in person.
  • You and your partner must have been in a relationship akin to marriage or civil partnership for a minimum of 2 years.
  • Your relationship must be genuine and ongoing.
  • You and your partner must plan to live together permanently in the UK.
  • Any prior relationship you or your partner had must have ended permanently.
  • You must meet the financial requirement.
  • There must be suitable accommodation for you and any dependents.
  • You must demonstrate an understanding of English at the required level.

Status of the Sponsoring Partner

To qualify for a UK Unmarried Partner Visa, your sponsoring partner must meet one of the following criteria:

  • Be a British or Irish citizen residing in the UK; or
  • Hold indefinite leave to remain, settled status, or permanent residence in the UK; or
  • Have pre-settled status under Appendix EU; or
  • Hold limited leave to remain as a Turkish Businessperson or Turkish Worker under Appendix ECAA; or
  • Have refugee leave or humanitarian protection status in the UK.

A British Citizen in the UK also includes a British Citizen who is accompanying you to the UK as your partner. A person with indefinite leave to remain includes someone who is being admitted for settlement at the same time as you.

UK Unmarried Partner Visa relationship requirements

To qualify for the UK Unmarried Partner Visa, the relationship must meet the following criteria:

Meeting in Person: You and your partner must have met face-to-face, not just through phone or written contact.

Relationship Duration: You must have been in a relationship similar to marriage or civil partnership for at least two years before applying.

Genuine and Ongoing Relationship: Evidence must show that the relationship is genuine, ongoing, and not just a formality. This includes factors like living together, having children together, sharing financial responsibilities, and plans to live in the UK.

Intent to Live Together Permanently: You both must demonstrate a clear intention to live together permanently in the UK after the visa is granted.

While living together for two years is no longer a strict requirement, the Home Office will require evidence of the relationship’s genuineness and longevity. They will consider documents showing regular contact, emotional support, cohabitation, and shared responsibilities. If there are concerns about the authenticity of the relationship, further checks or interviews may be conducted.

If applying for further leave to remain or indefinite leave, the Home Office expects a limited time spent outside the UK, unless for valid reasons such as work or study.

Previous Relationship must be broken down : The Home Office requires that any previous relationship, whether marriage or civil partnership, has permanently ended. If the previous relationship was not legally dissolved, you must still provide evidence that the new relationship is genuine and ongoing.

Financial Requirement: To qualify for the Unmarried Partner Visa, you must show a gross annual income of at least £29,000 or other forms of financial support such as savings or income from employment, self-employment, rental income, or pensions. The financial requirement must be met at the initial application, during extensions, and when applying for indefinite leave to remain.

Accommodation Requirement: You need to prove that you and your partner have adequate accommodation in the UK. This includes providing evidence that the property is legally occupied and not overcrowded.

English Language Requirement: Unless exempt, you must demonstrate English proficiency. This can be done by passing an approved English test or holding a degree taught in English. Exceptions are made for those over 65, with physical or mental disabilities, or due to exceptional circumstances.

Supporting Documents: The most common reason for Unmarried Partner Visa refusals is insufficient documentation. It’s important to submit the correct documents as required by immigration rules, tailored to your individual circumstances.

 

Unmarried Partner Visa Fees, Processing, and Key Benefits

Application Fees and Processing: The Home Office fee for an application outside the UK is £1,846, while in-country applications are £1,048. Processing times vary; applications from outside the UK generally take up to 24 weeks, and in-country applications take about 8 weeks.

Visa Duration and Extension: If granted, the Unmarried Partner Visa is valid for 33 months initially. After spending 5 years in the UK on this visa, you may be eligible for indefinite leave to remain, provided you meet additional requirements like passing the Life in the UK test and demonstrating a higher English proficiency level.

Right to Work: Unmarried Partner Visa holders have the right to work in the UK.
