Rehabilitation After a Serious Accident

We aim at Advantage Solicitors to introduce rehabilitation as soon as possible after a serious accident as we understand early intervention can be crucial to the recovery process.  We will immediately liaise with the Defendants insurers and invite them to arrange an immediate needs assessment with the appropriate rehabilitation agency.

We would ask that they appoint a case manager which will help the injured party with their medical treatment needs and transportation if necessary.

Overview

The UK legal system recognises the importance of rehabilitation and, through the Rehabilitation Code, encourages collaboration between solicitors, insurers and medical professionals to ensure injured individuals receive timely and appropriate treatment.

The Rehabilitation Code 2015

The Rehabilitation Code 2015 provides a framework for ensuring that injured individuals receive early rehabilitation, regardless of liability disputes. The Code promotes cooperation between all parties involved in a personal injury claim, including the injured person, their legal representatives, insurance companies, and healthcare providers.

Key Principles of the Rehabilitation Code:

1. Early Assessment – An injured person should be assessed as soon as possible by a qualified medical professional to determine their rehabilitation needs. The sooner rehabilitation begins, the better the chances of recovery.

2. Collaborative Approach – The injured person’s solicitor and the defendant’s insurer are encouraged to work together to facilitate rehabilitation, focusing on the injured party’s needs rather than legal arguments over liability.

3. Independent Rehabilitation Case Manager – A Case Manager, usually a medical or

rehabilitation specialist, is appointed to assess the injured person’s condition and recommend suitable treatment. The Case Manager remains independent and ensures that the rehabilitation is appropriate and effective.

4. Funding of Rehabilitation – The Code encourages insurers to fund rehabilitation costs at an early stage, even before liability is determined, ensuring that financial concerns do not delay vital treatment.

5. Tailored Rehabilitation Plans – Every injury is different, so the rehabilitation process should be personalised to the individual’s specific needs, whether that involves physiotherapy, occupational therapy, psychological support, or home adaptations.

Types of Rehabilitation Available:

Depending on the severity of the injury, different rehabilitation services may be required:

Physical Rehabilitation – Includes physiotherapy, hydrotherapy, and specialist treatments to restore movement and strength.

Cognitive Therapy – Support for individuals who have suffered brain injuries, helping with memory, concentration, and cognitive functions.

Psychological Support – Includes counselling and therapy for those experiencing post-traumatic stress disorder (PTSD), depression, or anxiety following an accident.

Occupational Therapy Helps individuals regain independence by adapting daily tasks to their abilities, including returning to work.

Assistive Technology & Home Adaptations – Installation of mobility aids, prosthetics, and home modifications to improve quality of life.
